Today I sent a letter (see below) to House Speaker Nancy Pelosi and Majority Leader Harry Reid. Despite the enormous fiscal impacts to the State, Arizona’s Attorney General has not yet made public his position on the massive federal entitlement expansion. Therefore, I will coordinate with other State Attorneys General on behalf of the State of Arizona to legally challenge the President’s health care bill.

Dear Speaker Pelosi & Majority Leader Reid:

On December 30, 2009, the Attorneys General from several states wrote you expressing grave concerns about the Senate version of the Patient Protection and Affordable Care Act (H.R. 3590). Although amendments have been made to this bill since then, the primary constitutional defects remain. It is reported that Democratic Congressional leaders intend to move forward with legislation that uses this bill as its starting point. I therefore, on behalf of the State of Arizona, join these Attorneys General and urge you to reject H.R. 3590 and any legislation that contains similar legal deficiencies.

As Governor and the statutory officer authorized to communicate with Congress on behalf of the State of Arizona, I have contacted Arizona’s delegation on more than one occasion expressing my serious policy concerns with H.R. 3590. Last week I wrote President Obama and told him quite clearly that Arizona simply cannot afford the unfunded mandate that will result from this legislation and outlined the disproportionate impact it will have on Arizona citizens.

The devastating impacts of the federal legislation will rob Arizonans of their rights and pocketbooks alike. One of the core principles of our nation’s system of government is the critical balance between the power of the federal government and the protection of individual liberties. The constitutional framers granted Congress only certain enumerated powers and provided that all other powers are reserved to the states or the people pursuant to the Tenth Amendment.

H.R. 3590 represents a sweeping violation of these fundamental principles established by the founding fathers. By requiring all citizens to purchase health insurance or be penalized, this bill would impose on the people an unprecedented mandate by the federal government. As emphasized by the non-partisan Congressional Budget Office:

“The government has never required people to buy any good or service as a condition of lawful residence in the United States.” This mandate violates the founders’ intent to limit the intrusion of the federal government upon the rights of the individual.

The Commerce Clause is erroneously cited as a legitimate basis for Congress to impose the requirement to purchase insurance. As you are aware, the congressional power to regulate commerce is not without limits. The sole basis for claiming constitutional authority under the Commerce Clause is seemingly derived by coercing Americans to engage in commerce through the purchase of insurance and then regulating that coerced transaction. Even the non-partisan and independent Congressional Research Service raised serious concerns about the constitutionality of this proposal, noting that it may very well go beyond the bounds of the Commerce Clause.

I must also strenuously object to the benefit exchanges the proposed legislation would impose upon states. H.R. 3590 requires states to either enact state legislation and regulations to implement these exchanges or be forced to allow the Secretary of Health and Human Services to take over and do it for them. This requirement is not a condition to receive federal funding, but rather an absolute mandate to the states in direct contravention of the Tenth Amendment.

For the foregoing reasons, I will coordinate with the other State Attorneys General on behalf of the State of Arizona to challenge H.R. 3590 or any health care proposal that becomes law with any of the unconstitutional provisions I have outlined in this letter. Thank you on behalf of the citizens of Arizona for your consideration of these matters.

Governer, Thank-you for speaking out for all those of us who can't by ourselves. In our 70's, moved here from a northern state 3+yrs ago with daughter and 3 grandkids 9 & under. We are appalled. Husband 30 yr Army Vietnam Vet + 15 odd yrs government employee, to see this and no Constituent coming foreward to do the job they were trusted/elected to do, (not one) including Barack Obama. All we hear from him and all the rest is blah, blah, blah! It is an "ABUSE OF POWER", as far as we are concerned, they are all just as guilty as all these law breaking "ILLEGALS". We don't support any type of amnesty, they all need to go back where ever they came from. I am American born Mexican American - I am American. I am not afraid of being stopped and asked for "identicification" or "proof of citizenship". Like every other American we have always had to show some type of ID, whether it is a Driver's license, car Registration/Proof of Insurance. As a 50 yr Army wife, we show our ID card. At the Library we show a library card, and I could go on and on. The problem is that all the protesters including this President have turned this into a political issue tor votes. We love Arizona, and all the United States. We pray that you come out on top and show everyone that is against this. You are a brave, independent, honorable Lady and we are so proud of you. Jan I am a born and rasied Arizona citizen. I now live in New Mexico with my husband and child. I will support AZ in anything. I think what alot of these other states are doing is childish and wrong. They need to read the bill that has been on the books for way over 60 years before they start throwing stones at AZ. The immagration Law has always been there, It just never was enforced because crooked politians seen money signs in there eyes and so did a majority of businesses, for cheap labor. By not securing borders its sentinceing US citizen to death and exteme proverty. And the ""president"" doesnt care all he see's is money sign as well. And finally someone with guts and compassion steps up to enforce a law that has been on the FEDERAL books for over 60 years, and they get nothing but crap from other states and Obama. Im boycotting mexico and whatever other place that is part of mexico and so is my whole family and a number of my friends. And I am not rasist Because my husband is hispanic and hes ragging mad over all the bad treatment AZ is getting. We cant go into other countries and try to take over or make them have bilengual you have to abide by there laws or face there punshiment. so why do we have to be any different? they want in here they better do it legal! or face our punshiment. I agree with you governor. As a physician I STRONGLY oppose the Obama's health care bill. One thing that shocked me was that they want to cut physician reimbursement by 40%. All that will happen is that we as physicians will not be accepting Medicare or "public option' patients. Already, large organizations such as the Mayo Clinic, are not accepting new Medicare patients. So Obama will have a lot of people that are ' covered' that still can't find a doctor. I know the AMA supports it; so I tore up my AMA card and sent it back to them.

Arizona's new law. I think it is important to say that you have a right to allow who you what into your own house. You would not just let anyone and everyone walk in to your home and use up your stuff! I feel that collectively this also applies to a city, county, and a state. This is a matter of having the "Respect and the Responsibility" to follow the law and respect the home you have "ask" to come into. You can't just say, "I will do what I want" and invade our home or my or your personal home. You all know if someone did this to you in your house, you would throw them out. First you would call the sheriff, however if they did nothing, like our Federal Government, you would get the job done yourself. It might take you and your friends, but you would get it done. The laws about this are already there, but our Federal Government has chosen not to enforce them. This is just another grand example of the lack of "Respect and Responsibility" this administration has shown for the citizens of the USA and the Constitution and Bill of Rights. This is a very sad development in our wonderful history. Arizona is only doing what they have to do. Just as you would if you were invaded!

I hear from the people around me (not seeing the future or that this country will become a "Mexico" or 3rd world country if we allow it) that this SB1070 bill is a sin and racist, but what these people have to understand is that "laws" were created millions of years ago when Moses, under God's authority, presented "The Ten Commandments"! There have always been laws that's why we live or are trying to live in a more civilized nation AND SOCIETY and that we will not allow these laws to broken!! Congress is a hyprocrite in that they look the other way when it comes to illegal immigration policies. When I drop my kids to school, I see all these Mexican plate cars dropping their kids in our schools yet alot of these schools claim that there will be more and more cuts, teachers ARE being laid off, schools closing, yet these people laugh in our faces because they don't pay a penny in taxes but get away with it! HOW IS THIS POSSIBLE????? NOW FOOD STAMPS, THESE PEOPLE COME IN HERE, AND ARE ALLOWED TO GET FOOD STAMPS AND AHCCS, HOW IS THIS POSSIBLE WHEN OUR STATE IS IN THE RED?????/ ALL ON TAX PAYERS SWEAT!!!! I only heard today that our wishy washy democratic State Attorney General was going to do NOTHING about this travesty they call health care. I am a citizen by choice and not by birth. I came from a country that has socialized medicine and have seen the devistating effects it has on the people. Waiting lists for care, so that when their number comes up it is too late and the treatment is invain or they die before they can get the treatment needed. IS THAT WHAT WE WANT? No we don't. Please continue to work for the citizens of Arizona to allow us to determine what kind of Insurance we want for our heatlh care. Yes, reforms are needed in health care but this is not the way to do it.

Thank you, Governor Brewer, for opposing this health care bill. I really find it quite troubling to be a citizen of a ā€œfreeā€ nation only to have extreme liberalists, including our president, think they can take my inherited right to choose away from me with their egotistical notion that they know (more than I) what is best for me and for each and every other citizen of our great country. These matters should be left to individuals, not government! These types of actions, if passed into law, are the beginnings of a socialist government. Unfortunately, many of our young countrymen have no clue as to what socialism is, if they did, I doubt they would be supporting this bill and our current president. Plain and simple, socialism is a nice word for communism. Last I checked, we are a ā€œfreeā€ nation, therefore our government has no right to tell its citizens how to manage their medical care. Nor does the government have the right to tell us who we can see, when we can see them or if our medical situation will be treated at all. There is a reason why Canadian doctors left that country when socialized medicine was imposed. There is a reason why Canadian citizens travel to the US to obtain medical treatment. A Canadian friend of mine has been waiting 2 years to have a gallbladder surgery. This is what socialized medicine will do for the US. Our medical professionals and citizens will do the same thing as our Canadian friends if this bill is passed. Many Americans already travel to Mexico and other countries to obtain medical treatment. This is what our liberal government and liberal minded individuals are driving our countrymen to with this proposed bill. This type of governmental control over its citizens, who are supposed to be "free" to choose, will make other countries rich on our medical needs and take away our constitutional right to choose. PLEASE, keep up the fight against H.R. 3590.

My wife had cancer in 2007 and we went to the Cleveland Clinic in Ohio where she got the best care available in the world. Governor Jan Brewer, I would like to commend you greatly for standing up for what is right. This healthcare package currently being debated should in my oppinion be thrown in the trash. Any bill that provides for taxpayers hard earned dollars to be used to support the results of peoples bad choices is wrong especially when the result of those bad choices lead to even worse descisions like abortion. The way to deal with abortion is to make people responsible for there choices, Pregnancy does not just happen it took two people making a choice.
